FCC says it didn’t try to game courts in 5G order challenge

In a letter obtained by Bloomberg Law, Timothy B. Strachan, director of the FCC’s Office of Legislative Affairs, said “Chairman Pai has informed me that neither he nor his staff urged any FCC licensee to challenge the Wireless Infrastructure Order, nor did they make any threats, implied or otherwise, against any licensee regarding such challenges.” The FCC in the letter said that its Office of General Counsel only had “standard communications with litigants” regarding its role in collecting and sending petitions to the Judicial Panel on Multidistrict Litigation.
